Joseph M. Esposito is a litigation associate at Spiro Harrison & Nelson. Joseph’s practice is focused on high-stakes litigation matters on behalf of businesses and individuals in state and federal courts across the country, including antitrust, appellate, False Claims Act, and complex commercial litigation matters. Joseph also represents businesses in arbitration proceedings.
Prior to joining Spiro Harrison & Nelson, Joseph clerked for the Honorable Douglas M. Fasciale of the Superior Court of New Jersey, Appellate Division, where he conducted extensive research to assist appellate panels in a wide range of civil, criminal, and administrative legal issues.
Joseph is a graduate of Seton Hall University School of Law, where he graduated with cum laude honors. During his time at Seton Hall, Joseph served as an Articles Editor for the Seton Hall Law Review, and participated as a student attorney in the Center for Social Justice Civil Litigation Clinic, working alongside other student attorneys and supervising attorneys litigating on behalf of Section 8 housing recipients. Joseph also interned for the Honorable Raymond A. Reddin (ret.) of the Superior Court of New Jersey, Law, Division, Civil Part, as well as the Honorable Katharine S. Hayden of the District of New Jersey.
Representative Matters
- Represent relator in one of largest qui tam cases in country related to alleged underbilling of E911 surcharges by certain telecommunications companies in New York dating back to 2007.
- Counsel on appeal for company asserting RICO violations in connection with the theft of $62 million in microfinance loans and subsequent transfer across international borders.
- Counsel for supplier of medical equipment to federal government agencies prosecuting equipment manufacturer for terminating contractual relationship in retaliation for raising concerns regarding medical equipment that was not fit for government use.
- Counsel for pharmaceutical industry training agency in AAA arbitration regarding dispute with former member over appropriate distribution of assets pursuant to separation agreement.
- Represent relator in successful appeal of dismissal of False Claims Act claims in connection with nationwide scheme to defraud Medicare and Medicaid through the submission of false reimbursement claims for home health services either not provided or medically unnecessary.
- Represent software developer alleging contractual partner wrongfully terminated services agreement and misappropriated confidential and trade secret information to jumpstart in-house development of underlying software.
- Represented healthcare company alleged to have breached contract for recruitment and referral of candidate for medical staff and successfully obtained dismissal of action against client.
